RULE 3003: CLAIMS IN
CHAPTER 11 CASES
The last date for the filing of claims in a chapter 11
case shall be ninety (90) days after the date first
scheduled for the meeting of creditors. The Clerk shall
give notice of that date in the meeting of creditors
notice.
RULE 3010: SMALL
DIVIDENDS IN CHAPTER 13 CASES
In Chapter 13 cases the trustee is authorized to pay
dividends of less than $15.00.
RULE 3015: HEARING
AND CONFIRMATION OF CHAPTER 13 PLAN
a. The Clerk will schedule the hearing on
confirmation of chapter 13 plan for a date
immediately after the period to file claims has
expired.
b. Objections to confirmation of the chapter 13
plan shall be filed with the court and served on the
debtor, the debtor's attorney, the trustee, and on
any other entity designated by the court, not less
than twenty (20) days prior to the scheduled
confirmation hearing. Objections that are timely
filed will be heard on the same date of the
confirmation hearing.
c. All requests for compensation by debtor's
attorneys will be heard on the same date that the
hearing on confirmation of the chapter 13 plan is
scheduled. Any supplemental request for services
rendered after the filing of the Rule 2016 (b)
Disclosure Statement must be filed with he Court and
served on parties in interest not less than twenty
(20) days prior to the scheduled confirmation
hearings.
d. If the Court denies confirmation of the
debtor's plan, the Court may enter an order
dismissing the chapter 13 case, unless, within eleven
(11) days after entry of the order denying
confirmation:
- the debtor files a modified plan,
- the debtor moves to convert the case to one
under another chapter of the Bankruptcy Code,
- the debtor files a motion for reconsideration
or appeals the denial of confirmation, or
- the Court otherwise orders.
e. In the event that a chapter 13 case is
dismissed, the chapter 13 trustee shall file a final
report and accounting within thirty (30) days from
the date of entry of the order of dismissal.
